By securing a charter or by utilizing our Service, you consent to comply with these Terms. Should you refute any portion of the terms, you are thus restricted from using the Service.
2. Service Overview
SoftPaperGarden offers an array of high-end yacht chartering services including, but not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate getaways
- Private celebrations
- Extended sailing excursions
We provide all services based on their current availability and prevailing weather conditions. The company retains the authority to adjust or cease services without prior notification.
3. Booking and Reservations
3.1 Booking Process
When arranging for a charter, ensure you:
- Are no younger than 18 years
- Supply truthful and full details
- Make a payment for the necessary deposit as denoted in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking is considered confirmed only when payment is received and we provide written confirmation. We reserve the right to deny service at our sole discretion.
3.3 Availability
The availability of our charters is contingent on vessel allocation and appropriate weather conditions. We will attempt to accommodate your preferences for charter dates and times where possible.
4. Payment Terms
4.1 Pricing
The prices we quote are in € and incorporate all relevant taxes unless specified otherwise. Prices are subject to alteration without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the total charter fee is payable upon booking.
- Balance: Required 48 hours before the charter commences.
- Incidental charges (as applicable): Payable at the conclusion of the charter.
4.3 Payment Methods
Payments are accepted via major credit cards, bank transfers, and certified cheques. Our secure and encrypted systems handle all payment processing.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours before departure: You will receive a full refund, minus processing charges.
- Between 24 to 72 hours before departure: 50% refund of the payment.
- Less than 24 hours before departure: No refund will be issued.
5.2 Weather Cancellations
If the captain deems weather conditions to be dangerous, we will propose to:
- Rebook your charter for the soonest available date at no extra charge.
- Issue a full refund if a reschedule is not feasible.
5.3 Mechanical Issues
Should there be mechanical failures with the assigned vessel, we will strive to provide an appropriate substitute. If an alternative is not available, you will be granted a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Heed all directions from the crew.
- Use safety equipment as needed.
- Disclose any medical conditions that could impact their security.
- Stay within the designated areas aboard the craft.
6.2 Prohibited Items
The following items are not permitted onboard:
- Glass containers
- Illegal substances
- Firearms or weapons
- Excessive quantities of non-alcoholic beverage
- Pets (exc ept when given prior approval)
6.3 Conduct
Passengers should behave respectfully at all times. We reserve the authority to terminate a charter without refund if a passenger's conduct presents a threat to safety or disrupts the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
Our responsibility to you is confined to the sum paid for the charter. We are not accountable for:
- Injuries incurred by passenger negligence.
- The loss or destruction of personal belongings.
- Indirect, incidental, or punitive damage claims.
- Delays resulting from adverse weather or events out of our control.
7.2 Insurance Coverage
Our vessels and operations are covered by a comprehensive marine insurance policy. It is your responsibility to procure your own travel and personal insurance.
7.3 Assumption of Risk
Your participation in our services indicates an understanding that maritime activities bear inherent hazards, for which you accept full responsibility for your safety and actions.
8. Modifications and Itinerary Changes
We retain the right to alter itineraries, pathways, or schedules subject to weather, safety, or operational needs. Whenever such adjustments are needed, we will endeavor to offer alternatives that are comparable.
9. Force Majeure
Our hands are tied in the face of delays, cancellations, or changes driven by circumstances beyond our command, which can include but are not exclusive to:
- Extreme weather scenarios
- Natural calamities
- Regulatory enactments
- Port operation interruptions
- Unpreventable mechanical breakages
10. Privacy and Data Protection
Your private data is managed in line with our Privacy Policy. Engaging with our Service signifies agreement to our data collection and utilization as detailed in the Privacy Policy.
11. Intellectual Property
Our website content, encompassing text, imagery, logos, and other visuals, is safeguarded by copyright and trademark statutes. Unauthorized replication, distribution, or creation of derivatives is prohibited without express consent from SoftPaperGarden.

The applicability of these Terms is subject to the laws in force within Monaco. All disputes fall under the jurisdiction of the courts sited in Monaco-Ville, Monaco.
